Terms and Conditions — TastyPlan

These Terms and Conditions ("Terms") govern the use of the mobile application TastyPlan operated by Kwargs, s.r.o.. By downloading or using the application, you agree to these Terms.

2. Description of the Service

TastyPlan is a mobile application designed for nutrition tracking, meal planning, food diary management, and providing personalized recommendations including AI analysis of food photographs.

3. Registration and User Account

Registration requirements:

You must be at least 18 years old.
Provide truthful and up-to-date information.
Have a valid email address.
Agree to these Terms and the Privacy Policy.

Account security: The user is responsible for protecting their login credentials and for all activities performed under their account. Report suspicious activity to info@kwargs.sk.

4. Use of the Application

Permitted use:

Personal nutrition and health tracking.
Logging meals and drinks and their analysis.
Meal planning and goal setting.

Prohibited use: unlawful purposes, providing medical diagnoses instead of a qualified health professional, copyright infringement, creating fake accounts, disrupting the operation of the service, or automated data extraction.

5. AI Analysis and Data Accuracy

AI features provide estimates of portions and nutritional values, and their accuracy is not guaranteed to be 100%. Information obtained in the application is for informational purposes only and cannot replace consultation with a doctor or a qualified nutritional advisor.

Important health notice: The application is not a medical device and is not intended for diagnosis, treatment, or prevention of diseases. For health problems, consult a qualified healthcare professional.

6. Google Health Connect Integration

The application allows optional connection to Google Health Connect on Android devices. This integration:

reads activity data (calories burned, steps) and weight from other health applications,
writes nutritional data, fluid intake, and weight to Health Connect, making them available to other connected applications.

All data is processed locally on the device. The connection is voluntary, requires the user's explicit consent, and can be disabled at any time in the application settings. Kwargs, s.r.o. is not responsible for the accuracy of data provided by third-party applications through Health Connect.

7. Content and Intellectual Property

All application content (design, text, images, algorithms) is protected by copyright and is the property of Kwargs, s.r.o. By uploading content, the user grants Kwargs, s.r.o. a non-exclusive, worldwide license to use such content for the operation of the service.

8. Payments and Subscriptions

Basic features are available free of charge. Premium features are provided through subscriptions (weekly, monthly, or annual) via Google Play. Subscriptions are automatically renewed unless canceled by the user. Cancellation is done in the settings of the respective app store; after cancellation, access remains until the end of the paid period. Current prices are listed at www.tastyplan.app/pricing and in the application.

9. Cancellation and Termination

The user may cancel their subscription at any time and request account deletion at info@kwargs.sk. Kwargs, s.r.o. may terminate or restrict access in case of violation of these Terms or misuse of the service.

10. Liability

The following provisions are formulated in accordance with the legal limitations applicable in the EU and the Slovak Republic.

Explicit statement of user requirement: Kwargs, s.r.o. ASSUMES NO liability for health consequences arising from the use of the application and does not provide compensation to users for health complications or losses arising from the use of the application.

Legal notice: Our company seeks to limit its liability to the extent permitted by law. This exclusion does not apply to cases of intentional conduct, gross negligence, or harm to the health or life of the user, if such limitation is prohibited by law.

In addition to the above, to the extent permitted by law, Kwargs, s.r.o. is not liable for indirect damages, lost profits, or losses incurred by the user as a result of using the application, unless such exclusion is prohibited by law.

11. Data Protection

The processing of personal data is governed by the Privacy Policy available at www.tastyplan.app. Please read it, as it forms part of these Terms.

12. Changes to the Terms

We may update the Terms. We will notify you of material changes 30 days in advance in the application or by email.

13. Dispute Resolution

Before filing a lawsuit, we will attempt to resolve the dispute out of court. Contact us at info@kwargs.sk. Consumers also have the right to use the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.

14. Governing Law

These Terms are governed by the laws of the Slovak Republic. Slovak courts have jurisdiction, unless legal regulations provide otherwise.
